1. About LookSmash
LookSmash is a free game in which players compare two photos and vote for one; photos get a rating (Elo) from these votes. It is provided by Arsen Pysaryk ("we", see the Impressum). By using LookSmash you agree to these terms. How we handle personal data is explained in the Privacy Policy.
2. Who may use LookSmash
- You must be at least 18 years old.
- You may vote without an account email. To upload photos you need an account with an email address.
- One person, one account. Keep access to your email secure; you are responsible for your account.
3. Your photos
- Upload only photos of yourself, which you took or have the right to use.
- Each photo must show exactly one face: yours. No other people, including in the background.
- No nudity or sexual content, no minors, no photos of other people without their consent, no hateful, violent or illegal content, and nothing that infringes someone else's rights.
You keep all rights to your photos. You give us a free, non-exclusive, worldwide licence to store, process (for example crop, compress and add the black bar over the eyes), and show your photos to other players within LookSmash, and to let them vote on them, for as long as the photo is on LookSmash. The licence ends when you delete the photo or your account; copies in short-lived backups disappear with them.
4. Fair play
Do not manipulate votes or ratings: no bots, scripts, multiple accounts, vote trading or other attempts to get around our limits. Do not harass other players, attack the service, or try to find out who is in a photo. Votes that break these rules may be weighted down or removed.
5. Ratings are a game
A rating only shows how other players voted in this game. It is not an objective or expert judgement of anyone's appearance or worth. If the game makes you feel bad, please take a break.
6. How we moderate content
Automatic checks. Before a photo is published, our servers check its format and size, that it shows exactly one face, and how likely it is to contain nudity. A photo that fails a check is not published, and you see the reason. A photo with a borderline nudity result is published but reviewed first by a person.
People. Moderators review new photos after they are published and every photo that is reported. They can approve a photo, remove it (you see the reason in your profile) or ban an account that breaks these terms. Photos reported for nudity or as showing a minor are hidden at once until a moderator decides.
Reporting. Players can report a photo in the app. Anyone, with or without an account, can report content through our contact form, including intimate images shared without consent, which we review within 48 hours.
Disagree with a decision? Write to [email protected] and a person will review it. You can also use any other remedy the law gives you, including the courts.
7. Ending the use
You can stop using LookSmash at any time and ask us to delete your account at [email protected]. We may suspend or ban an account that seriously or repeatedly breaks these terms; where possible we tell you why. We may change or end the service; if we end it, we announce it in advance where we can.
8. Availability and liability
LookSmash is free, and we do not promise that it is always available or free of errors. We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for breach of an essential obligation (one that makes the service possible at all and on which you may rely), and then only for typical, foreseeable damage. Otherwise our liability for slight negligence is excluded.
9. Changes to these terms
We may change these terms for good reasons, for example new features or new legal requirements. We tell you about important changes in the app before they apply. If you do not agree, you can stop using LookSmash and delete your account.
10. Law
German law applies. If you are a consumer living in another country, you keep the protection of the mandatory consumer law of that country.
